Terms of Service

These Terms of Service (“Terms”) form a contract between you (“Customer,” “you”) and Comura (“Comura,” “we,” “us”) and govern your use of the Comura website at comura.co and the Comura application (together, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. The Service
Comura places AI-driven follow-up phone calls on your behalf to the customers you tell us to call, transcribes and analyses those calls, and helps you respond to the outcomes (negative-sentiment alerts, review-link SMS, etc.). Features available to your account depend on your subscription plan.
2. Your account
You must be at least 18 years old and authorised to bind your business to these Terms. Keep your password secure and your contact information up to date. You are responsible for everything that happens under your account, including actions taken by team members you invite.
3. Your obligations when using Comura to contact your customers
This section is important. Read carefully.
- You must have lawful basis to call. Before you upload or schedule any customer for a Comura call, you confirm that you have the legal right to contact that person by phone for the purpose of soliciting feedback or sending a review request. In the United States this includes compliance with the Telephone Consumer Protection Act (TCPA), state mini-TCPA statutes, and any do-not-call registries that apply. In Canada, CASL. In the UK and EU, PECR / the ePrivacy Directive.
- Call recording disclosure.The AI agent records the call. Some US states (including California, Florida, Illinois, Massachusetts, Pennsylvania, and Washington) require all-party consent before recording. You are responsible for ensuring that your AI agent prompt and your business’ relationship with the called party satisfy applicable consent requirements. Comura’s default agent script includes a recording disclosure; do not edit that disclosure out without legal review.
- Calling hours. Your account configuration sets the window in which Comura will place calls. We default to the federally-permitted 8am–9pm local time window in the US. You are responsible for ensuring those hours comply with the rules that apply where your called party lives.
- Opt-outs. If a called party asks not to be called again, you must add them to the opt-out list in your settings (or accept that we add them automatically when we detect a clear opt-out signal). Comura will not place future calls to numbers on that list.
- Indemnification. You agree to defend and indemnify Comura against claims arising from your failure to comply with the above (for example, TCPA claims, all-party consent violations, or do-not-call disputes).
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including for political robocalls, debt collection, fraud, or harassment.
- Use the Service to contact people you do not have a prior business relationship with (e.g., cold outbound marketing or unsolicited sales calls).
- Reverse engineer, scrape, or attempt to extract source code from the Service.
- Resell or sublicense the Service without our written permission.
- Probe, scan, or test the Service’s security except through a coordinated vulnerability-disclosure email to help@comura.co.
5. Plans, billing, and refunds
- The Starter plan is a one-time free trial limited to 15 lifetime AI calls; we do not charge for it.
- Growth and Pro are paid monthly subscriptions billed via Stripe in advance.
- Enterprise is invoiced on a custom basis per the order form between us.
- All fees are non-refundable except where required by law or expressly agreed in writing.
- If your payment fails, we may suspend the Service after notifying you and a grace period.
- You can cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period.
6. Data
Our Privacy Policy describes what data we collect and how we handle it. As between us, you own the customer information you bring to the Service and the call recordings and transcripts generated for your account. You grant us a non-exclusive licence to process that data as required to provide the Service and to improve the Service in aggregate, de-identified form.
7. Confidentiality
Each party will protect the other’s non-public business information with the same care it uses for its own confidential information, and will not use it except to perform under these Terms.
8. Service availability
We work hard to keep the Service available but we don’t guarantee uninterrupted access. We may make changes, perform maintenance, or rate-limit usage as needed.
9. Warranty disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, COMURA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT AI-GENERATED OUTPUTS (SUMMARIES, SENTIMENT, ALERTS) WILL ALWAYS BE CORRECT. YOU ARE RESPONSIBLE FOR REVIEWING THEM BEFORE ACTING.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST DATA. EACH PARTY’S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID TO COMURA IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. NOTHING IN THIS SECTION LIMITS YOUR INDEMNIFICATION OBLIGATIONS UNDER SECTION 3 OR EITHER PARTY’S LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED BY LAW.
11. Termination
You may terminate your account at any time from the dashboard. We may suspend or terminate your account if you violate these Terms, including the obligations in Section 3, or if your account is delinquent. On termination, we will delete your account data per the retention schedule in the Privacy Policy.
12. Changes
We may update these Terms from time to time. If a change is material, we’ll notify you by email or in the dashboard at least 14 days before it takes effect. Continued use after that date constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any disputes will be brought in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
